These Terms of Use (“Terms”) govern your access to westerengames.com and, unless separate terms are provided, your use of games published by Westeren Games (“Westeren Games,” “we,” “us,” or “our”). By accessing the website or using a Game, you agree to these Terms. If you do not agree, do not use the website or the relevant Game.

1. Eligibility

You must be legally capable of agreeing to these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. Our Games are not specifically directed to children under 13.

2. Website Purpose

The website is a portfolio and information site for Westeren Games. It may provide descriptions, images, support information, privacy notices, and links to official stores or game portals. Website content may change without notice.

3. Limited License

Subject to these Terms and the rules of the platform through which you access a Game, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access the website and use the Games for lawful, personal, and non-commercial entertainment.

4. Prohibited Conduct

You must not:

• use the website or a Game unlawfully or to harm another person;
• attack, overload, disrupt, probe, or bypass security or access controls;
• upload or distribute malware, harmful code, spam, or deceptive content;
• cheat, manipulate scores, interfere with leaderboards, or exploit bugs;
• reverse engineer, decompile, modify, scrape, copy, redistribute, sell, or commercially exploit any part of the website or a Game except where applicable law expressly permits it;
• remove copyright, trademark, or other ownership notices;
• impersonate Westeren Games or misrepresent an affiliation with us.

5. Intellectual Property

The website, Games, source code, game designs, names, logos, artwork, icons, screenshots, text, audio, and other content are owned by Westeren Games or used under license and are protected by intellectual-property laws. “Westeren Games” and game names may be trademarks or trade names of their respective owner. No rights are granted except the limited rights expressly stated in these Terms.

6. Third-Party Platforms and Services

Games may be distributed through Google Play, CrazyGames, Lagged, Playgama, YouTube Playables, or other platforms. Your use of those platforms is also subject to their terms, community rules, payment rules, privacy policies, and technical requirements. Platform operators control their accounts, availability, moderation, billing, refunds, and data practices.

7. Advertising

Some Games are supported by advertising. Ads may be provided by third parties and may lead to external content. We do not control every advertisement or external destination. Advertising data practices are described in the relevant Game Privacy Policy and the provider's own privacy notice.

8. In-App Purchases

Some Games offer optional digital items or features through an app store. Purchases are processed by the applicable platform, such as Google Play. Prices, taxes, currencies, payment methods, parental controls, cancellations, and refunds are governed by the platform's rules and applicable consumer law. Unless the platform or law requires otherwise, digital purchases are licensed, not sold, and have no cash value outside the Game.

9. Game Accounts and Online Features

Some Games may use platform sign-in, achievements, leaderboards, analytics, reviews, or similar online services. You are responsible for maintaining the security of your platform account and complying with the platform's rules. We may remove or reset fraudulent scores, achievements, or access where reasonably necessary to protect a Game or its users.

10. Updates, Availability, and Changes

We may update, balance, modify, suspend, or discontinue any website feature, Game, online feature, virtual item, or supported platform. We do not guarantee that the website or a Game will always be available, error-free, compatible with every device, or preserved in its current form. Where required by law, this section does not limit mandatory rights.

11. User Communications

If you send feedback, bug reports, or suggestions, you grant us permission to use them without restriction or compensation, provided that we continue to handle personal information according to our Privacy Policy. Do not send content you do not have the right to share.

12. External Links

The website and Games may link to third-party sites or services. Links are provided for convenience and do not mean that we endorse or control the external service. You access third-party services at your own risk and under their terms.

13. Disclaimers

To the maximum extent permitted by law, the website and Games are provided on an “as is” and “as available” basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by law, Westeren Games will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, loss of profits, loss of goodwill, device incompatibility, or losses caused by third-party platforms or services. Our total liability arising from a Game or the website will not exceed the greater of the amount you paid directly for the affected Game during the twelve months before the event giving rise to the claim or the minimum amount required by applicable law.

This limitation does not apply to liability that cannot legally be limited, including liability arising from fraud, wilful misconduct, gross negligence where applicable, or mandatory consumer rights.

15. Suspension and Termination

We may suspend or terminate access to a Game or online feature if you materially violate these Terms, misuse a service, cheat, threaten security, or if the service is discontinued. You may stop using the website or a Game at any time and uninstall the Game.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. Courts and competent authorities in Türkiye will have jurisdiction, except where mandatory consumer law gives you the right to bring a claim in another jurisdiction or provides other non-waivable protections.

17. Changes to These Terms

We may update these Terms to reflect changes to our Games, website, providers, or legal requirements. The updated Terms will be posted on this page with a new “Last updated” date. Material changes will apply prospectively to the extent required by law.

18. General

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the applicable Privacy Policy and any platform terms, form the agreement relating to the relevant use.
